Innovapharm.com is operated by Innovapharm LLC (“Innovapharm,” “we,” “us” or “our”). These Terms govern use of our website and consumer purchases made directly through it. Our store is hosted on Shopify. Read these Terms together with our Refund Policy, Shipping Policy and Privacy Policy.
Eligibility and accounts
To place an order, you must be at least 18 years old or the legal age of majority where you live, whichever is higher, and have authority to enter into the purchase. Product-specific age restrictions and warnings may be more restrictive.
Provide accurate, current account, payment and delivery information. Keep your account credentials secure and notify us if you suspect unauthorized use. Do not use another person's account or payment information without authorization.
Products and safe use
Our products are dietary supplements and related goods. Website content provides general product and educational information and is not individualized medical advice. Dietary supplements are not intended to diagnose, treat, cure or prevent any disease.
Follow the directions, warnings and ingredient information on the product you receive. Consult a qualified healthcare professional about suitability, particularly if you have a medical condition, take medication, are pregnant or nursing, or have ingredient sensitivities. Do not exceed the labeled directions. Individual results vary.
We aim to present accurate product details and images. Packaging and screen colors may vary. This does not permit us to substitute a materially different product without your agreement or limit your rights if an item is misdescribed or defective.
Orders, prices and payment
Prices, availability and promotions may change prospectively. The order total, shipping charges and applicable taxes are shown at checkout before you submit payment. A later price change does not increase the price of an order already accepted.
We may limit quantities or decline or cancel orders because of suspected fraud, unavailable inventory, an obvious pricing or listing error, or misuse of a promotion. We will notify you of a cancellation and promptly refund amounts collected for canceled items, including associated shipping charges and taxes where applicable. We will not charge a corrected higher price without your agreement.
An automated order acknowledgment confirms receipt of your order; it does not prevent cancellation for the reasons described above. We will comply with applicable shipment-delay, cancellation and refund requirements.
Each promotion is subject to its stated eligibility, dates and conditions. Discounts cannot be combined unless the offer permits it. We may reject duplicate-account or other attempts to evade an offer's stated limits.
Personal purchases and wholesale
Consumer checkout is intended for personal use. Resale purchases should be made through an approved Innovapharm wholesale account under separate wholesale terms. We may decline consumer orders reasonably identified as unauthorized resale purchases. These Terms do not replace an existing written wholesale agreement.
Shipping, returns and cancellations
Delivery options, processing times and address requirements are described in our Shipping Policy. Return eligibility, return costs and refund timing are described in our Refund Policy. Contact results@innovapharm.com promptly if you need help with an order.
Nothing in these Terms transfers to you responsibility for an error caused by Innovapharm or removes a remedy that applicable law provides.
Privacy and optional marketing
Shopify hosts our store and processes personal information when you visit or make purchases. Shopify Network Intelligence is enabled: Shopify uses information from interactions with this store, other merchants and Shopify to provide enhanced services, including personalization and advertising-related services, subject to applicable privacy choices. Information is shared with Shopify and providers that may process it in other countries. Our Privacy Policy explains these uses and how to exercise your choices.
Our Privacy Policy explains how personal information is handled. Marketing email is optional. Purchasing a product, accepting these Terms, or providing a phone number for delivery does not itself subscribe you to promotional text messages.
If a text program is offered, it requires separate opt-in and the program disclosures presented at signup. Optional marketing choices do not prevent essential order, shipping, support or legally required communications.
Website content and permitted use
Unless otherwise identified, the website's text, graphics, logos, images and design are owned by Innovapharm or used with permission. You may browse the site and use its content for personal, noncommercial purposes. Other copying, commercial reuse or distribution requires permission or another lawful basis.
Do not use the site for fraud or unlawful activity, impersonate another person, upload malicious code, circumvent security controls, harvest other people's personal information, or interfere with the site's operation. We may restrict access reasonably necessary to address abuse or security issues.
Reviews and submitted content
You retain ownership of reviews, photos and other content you submit. By submitting content through a public review or upload feature, you grant us a nonexclusive license to host, display and reproduce it as needed to operate that feature. You must have the rights needed to submit it. Separate permissions may be required for other promotional uses.
Honest negative reviews are welcome. These Terms do not prohibit criticism, impose a penalty for a negative review, or transfer ownership of a review to us. We may moderate unlawful content, spam, personal information or content unrelated to the product under applicable review rules; disagreement with an opinion alone is not grounds for removing it.
Third-party services and links
Some payment, delivery and other services are provided by third parties, and linked websites may have their own terms and privacy practices. Their separate terms apply to those services where relevant. Their involvement does not remove Innovapharm's obligations for your purchase under applicable law.
Website availability and legal protections
We take reasonable steps to keep the website available and accurate, but access may be interrupted for maintenance, technical problems or circumstances beyond our reasonable control. To the extent permitted by law, the website's general informational features are provided as available without a guarantee of uninterrupted or error-free access.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable rights concerning defective or misdescribed goods, personal injury, fraud, gross negligence or willful misconduct. Statutory warranties and mandatory consumer remedies remain available. No statement here excuses us from fulfilling accepted orders or providing refunds required by law.
Resolving disputes and governing law
For a concern, contact results@innovapharm.com so we can try to resolve it. This request does not prevent you from using a court, contacting a regulator, or taking action needed to preserve your rights or meet a legal deadline.
Florida law and applicable U.S. federal law govern these Terms, subject to mandatory consumer protections that apply where you live. Disputes may be brought in a court with lawful jurisdiction. These Terms do not impose mandatory arbitration or a class-action waiver.
Changes to these Terms
We may revise these Terms and will post the updated version with its effective date. Changes apply prospectively and do not retroactively alter completed purchases or remove existing rights. We will provide additional notice or seek agreement where required by law.
General provisions and contact
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later. These Terms and the policies they incorporate govern the website and direct consumer purchases, without overriding mandatory law or a separate applicable written agreement.
